Imperial Cruise Services - To Cancel Membership And Refund Of Money Complaint Rating:

I went to shop at D-mart, on 21st of July, where a lady was standing who gave us a thing to fill and told that we will be getting a call if we are selected in lucky offer. Next day we got a call stating we are selected in lucky draw and called us to there office which is in Hinjewadi (5th floor, White Square Building). We went there on 22 July 2019, attracted by false advertisement and promotional offer ( they mentioned you don't have to pay anything and we will only distribute gifts), Then they asked us to attend 1 hr presentation in which they told us about various holiday packages and club offers valid for today only and will be giving it to limited 10 families only. They swiped our card stating you don't have to pay for first 45 days and you will get a call from the company to convert into EMI and after confirmation only your EMI will start., They also said that they are responsible for converting it into EMI of 1770 for 24 months with 0% interest. They swiped my card saying it is for registration only and future purpose EMI only, but the whole amount was debited and we did not get a single call from the company, Now the terms in the agreement are totally different from what the mentioned in the agreement. We asked them to cancel on the spot within 5 minutes of the agreement. They did not agree and took away the agreement after which we sat there with the customer care person till 11:30 in the night and told him that we are cheated by false statements. After explaining him everything he said that management will take a decision and will have to follow that. We dropped a mail on the same night at 11:30 sitting in the office mentioning that we want to cancel the agreement and later at 2:00 am in the night because we were worried for our money and fraud happened with us.
Day2 at the office: 23 July 2019: Next day we again visited the company to talk to the person who gave us presentation and he agreed to all the statements that in the presentation and which was different from the agreement. We told customer person that we don't want any of the services and free gifts and we want to cancel the agreement, now that the team member is also agreeing to all these things. But again we were asked to wait for 3 days for the mail from the management team. I again wrote a mail on the same day mentioning each and everything (every false thing told to us by team members) and asked them to cancel it.
Day 3 at office : After 3 days (26th July 2019) we visited the office. The person said that the management has taken a decision that as per the agreement the membership is non cancellable and if we want to cancel it,we will get 40% of the paid amount and 60 % will be forfeited and the person also started saying to use one service and then we will refund 40 %, but they were not understanding that we don't want any services. He was trying to convince again and again to use the service. But we told him that we don't want any service and we want full refund.
Now I am taking follow up again and again and when I asked that person about the management team he denied, I asked him to show us the mail of management team, he denied again, which simply states that there is no management team as such and these two persons ( customer care ) are only acting as one, and making us visit their office again and again,
We have neither taken any of the Free gifts nor any membership ID/Card or any benefits, and we don't want any, we just want our money back as we have got cheated by false statements.
1. Got cheated by false or misleading statements.
2. Making false promises mentioned different on the agreement.
3. Poor services and making us wait for days ( no management team as such, not showing management mails and person from management team)
4. Took signature on agreement by making false promises, which I asked them to cancel within 5 minutes ( Not letting us read all the points of agreement)
5. Reported all the issue twice on the mail and team member also agreed to what he said ( told us different from that of mentioned in agreement )
6. Waited till 11:30 at night and didn't get any proper response.
There is a section of Consumer Protection Act 2018, for making false/misleading advertisements, unfair trade practices and deficiency in services, you will be solely responsible for the punishment.
